OWNER’S ATV REGISTRATION AND LIABILITY INSURANCE
Offroad recreational vehicle (ORV) registration with number plate or sticker is mandatory on Crown land, including resource roads. The metal number plate or sticker must be clearly visible on the front, back or left exterior of the vehicle and securely fastened in a horizontal position. The registration and number plate or sticker costs a one-time fee of $48 and is valid as long as you own the vehicle. You must have in your possession a copy of the certificate of registration when riding.
On Crown land liability insurance is voluntary but recommended. On forest service roads you need a minimum $200,000 in third party liability insurance. Higher amounts of liability insurance are available at additional cost. Liability insurance can be obtained from ICBC or other insurers. You need a valid driver's licence to operate an ORV on forest service roads. You may want comprehensive coverage in case of theft, fire or a crash. This too is available at additional cost. You must have in your possession a copy of the insurance documentation when riding.
In the case of using an ORV to cross a highway or you load/unload your machine in a public parking lot you will need to purchase an annual vehicle licence sticker and specific insurance coverage from ICBC. This highway use is limited to incidental travel directly across the highway at a crossing controlled by stop sign or traffic light. As many of the trails in B.C. don’t line up according to the requirements needed in the ORV Act even if there were simply a few metres of variance, it would be considered an illegal crossing and a RCMP permit would be needed.
ATVBC & MEMBER CLUB’S INSURANCE
ATVBC’s master insurance policy covers its’ directors and officers from being sued by members of the organization. Anybody joining ATVBC must sign a waiver acknowledging that they accept this and that they waive any right to sue. The premium for this policy is paid from ATVBC membership dues.
Member clubs can get coverage under this policy to cover:
Club policies cover, and protect from lawsuits, the club’s named officers, directors and volunteers including ride leaders and assistant ride leaders (“Tail-gunners”). The details are covered in Section II of the club policy. The premium for club policies is calculated based on the number of members and kilometers of trails that the club sponsors as well as the number of rides or special events declared. The cost of this premium is paid from club dues. The deductible for a claim made for an incident which occurs in Canada is $1,000. The deductible for a claim made for an incident which occurs in the USA is $10,000. Coverage is void if it is determined that alcohol was consumed on a ride.
The ATVBC policy and individual club policies DO NOT provide individual members with insurance coverage (see owner’s registration and liability insurance above).
